Court Order

The court typically makes a decision on the preservation application within forty-eight hours of receiving it, especially in urgent cases where evidence is actively being removed from a facility.
Once approved, the judicial order is executed immediately by court officers.
Execution Method
Enforcement officers execute the order by entering the premises of the respondent, seizing physical assets, or copying digital hard drives. The judicial evidence preservation process is carried out with the assistance of technical experts who can securely extract source code, product designs, or transaction databases. This extraction is documented in a detailed inventory list that must be signed by the court officers and witnesses.
Any attempt by the respondent to obstruct this process is treated as a serious violation of civil procedure, resulting in fines or detention.

Cross-border disputes require foreign enterprises to act swiftly through local legal counsel to secure evidence located within the jurisdiction of mainland China. The application must be filed with the specific intermediate people’s court that has jurisdiction over either the respondent or the place where the evidence is located. Because foreign entities often face hurdles in gathering evidence due to state secret and data export laws, this judicial mechanism is often the only viable way to obtain and lock down critical local evidence for the trial.
It provides a formal, lawful channel that avoids the risks of unauthorized self-help, which could otherwise lead to severe administrative penalties for data extraction. Foreign applicants must ensure that their initial filings are perfectly prepared and accompanied by notarized power of attorney documents, as any delay can give the opposing party time to destroy the very evidence that the applicant seeks to preserve.
