In Chinese legal practice, SIAC arbitral awards are recognized and enforced under the New York Convention on the Recognition and Enforcement of Foreign Arbitral Awards. This framework allows a successful foreign litigant to seek enforcement against assets located within China, provided that the award complies with domestic public policy.
Legal Instrument
The award acts as a formal legal instrument that establishes the rights and obligations of the parties to the dispute. Once the tribunal issues the award, it becomes enforceable and can be presented directly to a Chinese court for execution. This direct route bypassed the need for a separate trial on the merits of the case, as the court’s review is strictly limited to procedural compliance and public policy issues.
Enforcement Process
A party seeking execution must file a petition with the Intermediate People’s Court where the respondent is domiciled or where the assets are located. The petition must be accompanied by the original arbitration agreement and a certified copy of the arbitral decision. The court then conducts a formal review of the application to ensure that the procedural requirements of the New York Convention have been satisfied.
If the court finds no grounds for refusal, it issues an enforcement ruling and refers the case to its enforcement bureau to locate and seize the debtor’s assets.
Operational Obstacle
Litigants should be aware that local courts may refuse enforcement on narrow public policy grounds, although such cases are rare in practice. This operational obstacle arises most frequently in disputes involving state-owned enterprises or sensitive industries where the national interest is directly affected. This possibility means that parties must carefully assess the regulatory environment and asset locations before initiating arbitration to ensure that a future award can be successfully executed.
